Who we are: Prodred is a suite of AI-powered tools for fashion and textile visual production, operated by Erigo Kreatif Innovations (“Prodred,” “we,” “us”). These Terms form a contract between Erigo Kreatif Innovations and the person or entity using our Services (“you”).

1) Using Prodred

• Eligibility.

  You must be at least 18 and able to form a contract. If you use Prodred for a company (e.g., a fashion brand, retailer, or agency), you represent you have authority to bind that company.

  
  

• Account.

  Keep your credentials confidential. You’re responsible for all activity under your account

  
  

• Subscriptions & limits.

  Plans include monthly generation/output allowances per user (credits). We may throttle processing to protect the platform. Enterprise limits are set by specific agreement.

  
  

• Payments.

  Fees are billed in advance per the plan you choose. Taxes/VAT may apply. Except where required by law or expressly stated, fees are non-refundable.

  
  

• Changes. We may add, change, or discontinue features (e.g., specific model availability or rendering engines). If a change materially harms your paid use, you may cancel; prepaid periods are not refunded unless required by law.

2) Your Content & Outputs

• Definitions.

  • “User Content” = files you upload (e.g., ghost mannequin shots, flat lays, design sketches, fabric swatches, reference photos), prompts, and any text instructions you provide.

  • “Outputs” = files our tools generate for you (e.g., on-model imagery, campaign visuals, video assets, or upscaled results).

    
    

• Ownership.

  You retain all rights to your User Content. Subject to applicable law and third-party rights, we assign to you any rights we may have in the Outputs we generate for you, excluding our underlying AI models, software, and intellectual property.

  
  

• License to operate the Service.

  You grant us a worldwide, royalty-free license to host, process, and transmit your User Content only to provide and improve the Service’s functionality, troubleshoot, and meet legal/security obligations.

  
  

• Model improvement.

  We do not use your User Content to train our public foundation models by default. You may opt in (or out) to allow training on your content to improve generation quality; if you opt in, we may retain copies for model improvement. Enterprise clients may have custom fine-tuning terms defined in a separate agreement.

  
  

• Feedback.

  If you provide feedback, we can use it without restriction.
  
  
  

3) Professional & Safety Notice

• Not Manufacturing Patterns.

  Outputs are visual representations for marketing, e-commerce, and editorial use. They are not technical manufacturing patterns, tech packs, or precise color-matching standards for production dyeing.

  
  

• Truth in Advertising.

  You are responsible for ensuring that the Outputs generated accurately represent the physical products you sell. Prodred provides tools for high fidelity, but you bear the duty of care regarding consumer protection laws, truth-in-advertising standards, and ensuring generated visuals do not mislead consumers regarding fabric quality, fit, or features.

  
  

• Accuracy. AI can produce errors or artifacts (hallucinations). Always review and validate visuals (hands, logos, text) before publishing them in any commercial setting.
  
  
  

4) Acceptable Use

You agree not to:

• Violate laws or third-party rights (including Intellectual Property and Privacy).

  
  

• Upload confidential information you don’t have the right to use (e.g., unreleased designs from a third-party brand).

  
  

• Attempt to extract source code, model weights, or underlying datasets.

  
  

• Use the Service to create deceptive or harmful content (e.g., deepfakes of non-consenting individuals, non-consensual sexual imagery, discrimination, or content that incites violence).

  
  

• Overload or interfere with the platform.

We may suspend or terminate accounts that breach these Terms or risk platform integrity.

5) Third-Party Services

Some features may rely on third-party infrastructure or integrations (e.g., cloud hosting, Unreal Engine integrations, authentication). Their terms may apply; we’re not responsible for their services.

6) Confidentiality

We will protect your non-public information (such as unreleased collection designs) with reasonable administrative, technical, and physical safeguards. Enterprise confidentiality and security commitments may be set in a separate agreement or DPA.

7) Term & Termination

You may cancel at any time via your account settings. We may suspend or terminate for breach, abuse, non-payment, or legal risk. Upon termination, your right to use the Service ends; we may delete your data after a reasonable period unless law requires retention.

8) Disclaimers

THE SERVICE AND OUTPUTS ARE PROVIDED “AS IS.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES (EXPRESS OR IMPLIED), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT ERROR-FREE OR UNINTERRUPTED OPERATION, NOR THAT OUTPUTS WILL MEET ANY SPECIFIC RETAIL COMPLIANCE STANDARD.

9) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

(A) WE WILL NOT BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL; AND

(B) OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO PRODRED IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

10) Indemnity

You will defend and indemnify Erigo Kreatif Innovations against claims arising from your User Content, use of the Service in breach of these Terms, or violation of law or third-party rights.

11) Export, Sanctions & Regulatory

You must comply with all applicable export and sanctions laws. You may not use the Service if you are in or for the benefit of a prohibited jurisdiction or party.

12) Governing Law; Dispute Resolution

These Terms are governed by the laws of Turkey. Disputes will be resolved in the courts located in İstanbul Anatolian Side, unless otherwise required by law. You and Erigo Kreatif Innovations waive class actions to the fullest extent permitted.

13) Updates to Terms

We may update these Terms from time to time. We’ll post the effective date above. If changes are material, we’ll provide reasonable notice. Continued use after the effective date constitutes acceptance.

1) Data We Collect

• Account & billing.

  Name, email, password (hashed), plan, payment tokens (processed by our payment provider), and billing details.

  Team memberships, feature usage (e.g., model generation types), device info, logs, and diagnostics.

  
  

• User Content.

  Files you upload (e.g., garment photos, patterns, ghost mannequin shots) and metadata necessary to process them.

2) How We Use Data

• Provide, maintain, and secure the Service.

• Process image files and deliver high-resolution Outputs.

• Prevent abuse, troubleshoot, and ensure reliability.

• Communicate about the Service, including transactional messages.

• Improve features and user experience (including anonymous analytics).

• Comply with law and enforce our Terms.

3) Model Training & Content Controls

• Default: We do not use your User Content (specifically proprietary fashion designs) to train our public foundation models.

  
  

• Opt-in: You may choose to allow training on your content (e.g., to create a custom LoRA or fine-tuned model for your specific brand); you can change this at any time in settings or by enterprise agreement.

  
  

• We may use aggregated, de-identified telemetry to understand performance and reliability.

4) Sharing

We share data with:

• Service providers (e.g., GPU cloud providers, storage, authentication, analytics, payments) bound by confidentiality and data-protection obligations.

  
  

• Enterprise integrations you enable (e.g., SSO or DAM systems).

  
  

• Legal/regulatory recipients when required by law or to protect rights and safety.

  
  

• We do not sell your personal data.

5) International Transfers

If we transfer data across borders, we use lawful mechanisms (e.g., SCCs) and safeguards to ensure your data remains protected.

6) Security

We use reasonable administrative, technical, and physical safeguards appropriate for high-value design files and imagery (e.g., encrypted transport and storage for content at rest where applicable, access controls, logging). No system is perfectly secure.

7) Retention & Deletion

• User Content and Outputs are retained as needed to provide the Service and to meet legal obligations.

  
  

• You can delete files from your account; backups may persist for a limited period.

  
  

• On account closure, we delete or anonymize personal data within a reasonable timeframe unless retention is required by law or to resolve disputes.

8) Your Rights

Depending on your location (e.g., GDPR in Europe, KVKK in Turkey, or US State Laws), you may have rights to access, correct, delete, port, or restrict processing of your personal data, and to object to certain processing. You can exercise these rights via your account or by contacting us at privacy@erigokreatif.com.

9) Children

Prodred is not directed to children under 13 (or the age required by your jurisdiction). We do not knowingly collect their personal data. While our tool allows for the generation of child-model imagery for fashion brands, the tool itself is for use by adults/businesses only.

10) Legal Bases

We process personal data based on:

11) Communications & Marketing

We send transactional messages related to your account. You can opt out of marketing emails via the unsubscribe link.

We’re not responsible for the privacy practices of third-party sites or services linked from Prodred.

13) Changes to This Policy

We’ll update this Policy from time to time. We’ll post the date above and, where required, notify you of material changes.
